20025. A Look at Financial Statements Through the Credit Manager's Eyes

20027. Liens and Bonds: The Process Through the Lens of Litigation

A credit manager entering the world of mechanic's liens and bonds may feel a little like Alice falling down the rabbit hole into Wonderland, a world populated by strange and crazed creatures who speak in riddles. The statutory notice and filing requirements are enough to make you feel like a Mad Hatter! But the fun does not end with providing the required notices and meeting filing deadlines. The next step is enforcing your lien and/or bond rights, along with your contractual rights, through litigation. Greg Powelson, director of NACM's MLBS and Karen Hart, a commercial litigator and creditor's rights attorney, will provide an overview of the lien and bond process with a focus on the litigation process. This session explains how to get started with job information collection, serving preliminary notices, filing liens in addition to how liens are foreclosed, how bond claims are adjudicated and how contractual claims fit into the landscape of the lawsuit. This session also illustrates how to avoid landmines in dealing with your debtor, generals, bonding companies and other parties, that can blow up in litigation.

20028. Credit Risk-No Safe Havens

The world is in turmoil, and there are no safe havens from credit risk, no safe regions or countries. Still sales must be generated and risk managed. A panel of credit practitioners and experts in risk management review and evaluate the methods and techniques they have utilized to manage the risk in their accounts receivable portfolios. Many important topics are covered including: security agreements, guarantees, letters of credit, credit insurance, credit default swaps, receivable puts, direct payments from end users, receivable purchase agreements and management of bad debt reserves.

20029. Risk Mitigation When Dealing with Troubled Companies Before, During and After Bankruptcy

Every credit executive dreads dealing with a financially ailing customer and the risk of it filing bankruptcy. This session offers two of your favorites, Wanda and Bruce, discussing practical approaches and precautionary steps to protect a goods or service provider and enhance the likelihood of payment of its claim against a financially struggling customer before and during its bankruptcy case. War stories recounting steps that creditors have taken to minimize their risk and improve the collectability of their claims are included. Topics covered include: pre-bankruptcy issues, such as warning signals of a customer's financial problems and the risk of its future bankruptcy filing; sources of information that identify a troubled customer facing the prospect of a future bankruptcy; credit enhancement devices to increase the likelihood of payment; and state law remedies mitigating risk of nonpayment. Some bankruptcy issues being addressed include: first day orders, selling to a Chapter 11 debtor: the risks and claim priority status, critical vendor treatment, Section 503(b)(9) 20 day goods priority, reclamation rights and pitfalls, executory contract issues, preference claims and defenses and how a creditors' committee can influence trade creditor rights in bankruptcy.

In this session we will provide a comprehensive understanding of the relationship between accounting profits and cash profits. Analysis of the cash flow statement begins with the interrelationships that exist between the balance sheet (investment and financing decisions) and the income statement (operating decisions). The results of a company's current investment decisions are found in two key operating assets: inventory and accounts receivable. Their activities represent both investment decisions and operating decisions by management. Cash is King!

State responsibilities and enforcement efforts, along with successful tips for ensuring your department is audit ready, are also discussed.
